ACCEPTABLE USE
Acceptable Use Policy.
This Acceptable Use Policy ("AUP") governs what may be hosted, sent, or run on infrastructure Schwen Scalability provisions and operates for you. It is part of, and incorporated into, our Terms of Service. You are responsible for your own conduct and for your end users' compliance with this AUP.
1. Prohibited Content & Conduct
You may not use the services, or allow anyone to use them, to host, transmit, store, or facilitate any of the following:
- Illegal content or activity — anything that violates applicable law, regulation, or third-party rights.
- Malware & phishing — viruses, worms, ransomware, spyware, phishing pages, credential-harvesting, or other malicious or deceptive code.
- Spam & unsolicited email — bulk or unsolicited commercial messages, and any use of the transactional-email service to send email to recipients who have not opted in. Email must comply with anti-spam laws (e.g. CAN-SPAM, CASL, GDPR/ePrivacy), include required identification and unsubscribe mechanisms, and use only domains and identities you are authorized to use.
- Intellectual-property infringement — content that infringes copyrights, trademarks, patents, trade secrets, or other IP rights.
- Exploitative sexual content — child sexual abuse material (which we report to authorities), non-consensual intimate imagery, or other unlawful or exploitative sexual content.
- Hateful, harassing, or violent content — content that incites violence or promotes unlawful discrimination or harassment.
- Resource abuse — crypto-mining, botnets, denial-of-service tooling, or activity that places an unreasonable or disproportionate load on infrastructure or degrades service for others.
- Attacks & unauthorized testing — probing, scanning, penetrating, or attacking systems or networks you do not own or lack authorization to test; circumventing authentication or security; or interfering with any user, host, or network.
- Deceptive or fraudulent activity — fraud, pyramid or Ponzi schemes, impersonation, or falsifying identity or headers.
- High-risk uses — use in environments where failure could lead to death, personal injury, or severe physical or environmental damage (e.g. life-support, emergency services, nuclear, aviation control) unless expressly agreed in writing.
2. Upstream Provider Policies
Your hosted assets run on third-party infrastructure (see Subprocessors). Your use must also comply with the acceptable-use and content policies of those upstream providers. A violation of an upstream policy is treated as a violation of this AUP.
3. Consequences of Violations
If we determine, in our reasonable discretion, that you or your end users have violated this AUP, we may remove or disable the offending content, throttle or suspend the affected services, or suspend or terminate your account. Where practical and where the violation is not severe or legally sensitive, we will give notice and an opportunity to cure first; for urgent, severe, or legally required cases we may act immediately. We may cooperate with law enforcement and preserve or disclose information where required or appropriate to investigate suspected violations or protect the safety of any person or system.
4. Reporting Abuse
To report a violation of this AUP, spam originating from our infrastructure, or other abuse, email matthew@schwen.me. Please include the URL or content in question and enough detail for us to investigate.
5. Copyright Reports
We respond to good-faith notices of alleged copyright infringement. To submit a report, send a written notice that includes: (a) identification of the copyrighted work; (b) identification of the material claimed to be infringing and its location (URL); (c) your contact information; (d) a statement of good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act; and (f) your physical or electronic signature.
Send copyright reports to matthew@schwen.me. This operational contact is not a representation that a U.S. Copyright Office designated-agent registration has been completed. We may remove or disable access to allegedly infringing material, forward a report where appropriate, and terminate repeat infringers.
6. Changes
We may update this AUP as our services and the threat landscape evolve. Material changes will be communicated with reasonable notice, and continued use after the effective date constitutes acceptance.
